Supreme Court Gives Thumbs Up to Texas Immigration Law

Unfortunately, the Fifth Court of Appeals put in a stay just a few hours after the Supreme Court last night. It was a Bush appointee and an Obama or Biden appointee that voted for the stay and Trump appointee that dissented. I think that they are having the hearing today. This is crazy. Just when you think you have a win. I am sure Paxton is working on it. If he wins, other states may pass similar laws.

Texas Attorney General Ken Paxton secured a major victory as the Supreme Court of the United States denied emergency motions filed by the Biden Administration and various other organizations seeking to block enforcement of Texas’s recent immigration law, SB 4.

Tuesday’s order vacates the administrative stay previously issued by the Supreme Court, thus allowing Texas to immediately enforce the law while the U.S. Court of Appeals for the Fifth Circuit decides whether to grant a stay pending appeal.

SB 4 was adopted to address the ongoing disaster at the Texas-Mexico border by making it a state crime to cross the border illegally—which is already a federal crime.

This enables Texas law enforcement to detain illegal aliens and for judges to order them to return to the country from where they illegally entered.

By design, SB 4 allows Texas to defend its sovereignty while not conflicting with federal law.

“For now, Texas has defeated the Biden Administration’s and ACLU’s emergency motions at the Supreme Court,” said Attorney General Paxton. “Our immigration law, SB 4, is now in effect. As always, it’s my honor to defend Texas and its sovereignty, and to lead us to victory in court.”

“This is about Texas sovereignty, rule of law, and the security of Texas communities— and today, justice prevailed,” Texas State (from Conroe, near Houston) Brandon Creighton wrote on X. “Texas needs to keep building its own border wall and we will negotiate for reimbursement when Trump is re-elected in November.”

“Crazy that Texas has to do the job of the Biden administration, which filed aggressive legal action to stop the state!” Elon Musk wrote on X. “If anyone still doesn’t believe that ushering in illegals is the goal of the Biden administration, this should convince them.”

  1. Perseverance, exposure, lots of prayer backup, and another one bites the dust. Little by little. I’m not hearing this on the news! Actually, not accustomed to MSM much, having to listen to it down here in the condo, it’s appalling how viciously unrelenting the twisted propaganda is. People who listen to it all the time have no idea what is really going on, in Texas, or anywhere. But this too, will turn around, only many still won’t get it. Good for Texas, who gets it, and leading the way!

    • No. I have a good contact in Austin. Right now Gov. Abbott & AG Paxton are fighting back on multiple fronts, including with a biased liberal media. The 5th Court’s ruling is only based on the SB-4 merits of the case. The actual actions & the laws regarding TX right to protect & defend itself from illegal invasion at border is a completely different issue that hasn’t been addressed in court yet. Texas can defend itself.
