On Thursday, the Santa Clara County Superior Court ruled a South Bay church pastor threatened with jail time for holding in-person services will remain free for now.
Robert Tyler, an attorney for Calvary Chapel in San Jose, made the announcement on the court steps just after 5 p.m. following the contempt hearing.
Please pray for Pastor Mike. In Acts 21, Paul was ready to go to jail for the Gospel. Pastor Mike McClure from Calvary Chapel San Jose continues to face the threat of jail time for insisting on preaching every week and gathering physically and unfettered as a congregation.
Pastor Mike knows the Bible and the United States Constitution. He has clearly felt the Lord compelling him to obey God’s law over the laws of a rogue California county, and he kept his church open during the pandemic.
Over the last few months Mike and the Church have amassed a whopping $1.6 million in fees and fines from the local government.
“I think the shutdowns are an absolute violation of the centrality of our liberty,” said McClure. “– and that is the freedom to believe, the freedom to express our belief, the freedom to worship.”
McClure has joined a growing list of religious leaders who are defying public health guidelines, maintaining that those restrictions infringe on their First Amendment rights.
Tyler & Bursch and Advocates for Faith & Freedom attorneys were able to prove that it is okay for 25 people to be waiting in a bus station, standing in a bank, or washing clothes in a laundromat, but 25 people doing a Bible study or washing their souls in worship is illegal, even though the sanctuary holds 2,000 people.
The case will be back in court on Jan. 28 for closing arguments.

Millions of Americans are calling “tyrannical” County of Santa Clara, California to stop punishing the pastors and church for holding weekly gathering worship services.
“To add insult to injury, the spineless #CassCommercialBank (a so-called “Christian” bank) are now defaulting on the mortgage for the church (that has always remained in good standing) and Pastor Mike has been given only 18 days to find a new lender,” one congregational member wrote.
“Christians (or people from any belief system who feel we should still have legitimate freedom of religion in America), it’s time to rise up, stand up, and raise up our voices in defense of this heinous abuse of power against a clergyman and his congregation.”
It is tough to realize we are in a time when tens of thousands can publicly protest without masks on, but hundreds cannot congregate in a Christian church.
Please pray that Mike avoids jail time and all of the fees and fines are waived.
Pray that a precedent is set for all other churches that wish to gather freely without government mandates or outright punishment.
