Progressive Liberal New Mexico Governor Blocked From Her Unconstitutional Firearms Order Suspension by Federal Judge

Today U.S. District Judge David Urias blocked part of New Mexico Democratic Gov. Michele Lujan Grisham’s public health order suspending the carrying of firearms in public in Albuquerque.

Federal Judge Urias issued the ruling against the liberal governor’s order on Friday.

The 30-day order would have barred the open and concealed carry of guns within the city and imposed fines on violators.

A nationwide backlash against her bizarre order  from gun rights advocates, Republicans, and Democrats alike, exploded with concerns about its constitutionality.

Even George Soros funded ($107,000) Democrat State Attorney General Raul Torrez, announced on Tuesday that he would not defend the governor’s order, saying “I do not believe that the Emergency Order will have any meaningful impact on public safety… I do not believe it passes constitutional muster.”

In January 2021, Zach DeGriego, Spaceport America’s former Chief Financial Officer, filed a civil complaint against Gov. Grisham regarding alleged fraud of $200 million.

DeGriego said he left his “position after making multiple whistleblower complaints. I was forced to resign when I had to choose between keeping my job and committing crimes.”

“After the governor and her staff got rid of me, they have done everything in their power to retaliate against me and destroy my life to keep me silent,ā€ he continued. ā€œAt the same time, they proceeded to violate multiple federal laws.”

The governor’s forced Covid restrictions in 2020-21 caused New Mexico to lead the nation in teen suicides. Schools were either closed or extremely limited on normal activities: sports, band, academics, etc.

Suicides were especially high near New Mexico borders where nearby competitions in adjacent states were in full mode with severe restrictions.

The governor also placed “health restrictions” in public places such as restaurants, that when gradually lifted, allowed dining areas to only permit limited capacity.

In 2022, State Rep. Randall Pettigrew (R-61) noted restaurants and other small businesses in New Mexico were competing with welfare.

All major New Mexico industry sectors experienced over-the-year job losses in 2021. Leisure and hospitality continued to report the heaviest employment losses, with a drop of 18,400 jobs, or 18.9 percent, compared to the previous year.

State Sen. David Gallegos (R-41) noted that  the forced shuttering of restaurants caused “some employees found other forms of work.”

“Others lost people to the (New Mexico Department of) Workforce Solutions and the unemployment checks that came up,” he continued. “Some want to better themselves with another job. That’s totally different than still sitting at home waiting for your unemployment.ā€

On a personal note, Dodie and I roadtripped through 16 states and the District of Columbia in 2020 and 2021 (we were not going to be restricted). We found the mandates and restrictions in New Mexico restaurants and hotels to be severe compared to other states.

We had to sign a register and provide identification (unlike their lax voting requirements) before we could dine if there was a table available.

Most of the restaurants had no more than six to eight diners allowed at one time. Masks were required unless you were physically eating or drinking. We felt sorry for those who did work because it was usually on a skeleton staff. Housekeepers in hotels were cutting corners and working longer shifts. Restaurant servers were noticeably worn out.

Workers begged for their jobs back

New Mexico has a trifecta of Democrats in power, meaning the governor, legislative, and judicial branches control the state.

In August 2021, the New Mexico Restaurant Association provided the following news release:

“The governor and, now state Supreme Court, have sufficiently crushed the hope of New Mexico restaurants and today’s decision by the court reiterates the despair our industry faces during this pandemic. The timing of the governor’s reopening at 25% is not lost on us, of course, we are happy to reopen at all. But the NM Supreme Court made it clear that there is no effective process in place to question a public health order. It is baffling that our state leadership continues to ignore the livelihoods of servers, cooks, and dishwashers, as well as the long-term economic impact of this prolonged closure. This is not data, not science, it is bad politics and restaurants remain at the mercy of the governor.”

  1. I watched her press conference when she announced this ridiculous gun ban. She basically said if she declares an “Emergency” she can take away your constitutional rights. Sound familiar? Exactly what they did during COVID. The socialist communist democrats do not believe in the Constitution or the Bill of rights. Watching her on TV I really had to scratch my head who would vote for her in the first place.

    • Exactly. These are Overton window tests to move the dial towards declaring under the guise of “Health emergencies” to control the masses & bypass the Constitution.
      I was surprised to see the Soros AG go against her. NM only allows 2 term governors, so perhaps he has his eyes on her position?
