
The lead attorney for petitioners in the Fulton County election fraud case said the judge’s recent decision is “a huge victory for everyone who wants to get to the truth about the way in which Fulton County mishandled the absentee ballot count.”
Attorney Bob Cheeley’s takeaway from Henry County Superior Court Chief Judge Brian Amero June 24, 2021 ruling was publically optimistic. One of his clients, Garland Favorito, also saw Judge Amero’s order as positive.
“We are pleased that the court has ruled in our favor again for the fifth time,” Favorito said in a prepared statement. “The ruling substitutes Defendants by replacing currently named government organizations with individual board members we named originally in our lawsuit.”
“It also moots Don Samuels’ attempt to dismiss our case,” Favorito continued. “This continues the string of victories we have including how we obtained the original protective order, conditional approval to inspect ballots, access to ballot images, and the order to unseal the ballots.”
The judge is allowing two of the nine claims against Fulton County and others alleged to be involved in fraud to proceed. This will require the county to produce digital images of some 150,000 mail-in ballots that are at the center of plaintiffs’ allegations of fraud in the November 2020 presidential election.
Amero also ruled that the respondents of the lawsuit—Fulton County, Fulton County Board of Registration and Elections, and Fulton County Clerk of Superior and Magistrate Courts—could not be defendants in the suit due to sovereign immunity protections.
Instead, Amero granted a request by the plaintiffs to add five named individual members of Fulton County’s Board of Registration and Elections as respondents in the case moving forward.

Don Samuel is the attorney for the Fulton County elections board. He is trying to spin Amero’s ruling as a win and indicated he will seek for a case dismissal.
Samuel also interpreted the judge’s ruling as preventing the plaintiffs from inspecting the absentee ballots with high-powered microscopes as requested.
Last month Amero granted a forensics review of the 147,000 mail-in ballots cast in the Nov. 3, 2020 presidential election.
The judge approved the audit after reading lawsuit information could prove fraudulent ballots and other irregularities led to Joe Biden’s 2020 win in Georgia.
The Democrat controlled Fulton County didn’t attempt to provide information, instead they immediately hired criminal defense attorneys to fight the lawsuit, resulting in a temporary block of the audit. But it was too late. The Georgia Star News, through the Open Records process, had been investigating them since at least December.

Suddenly, Georgia Secretary of State Brad Raffensperger turned on Fulton County election officials.
“New revelations that Fulton County is unable to produce all ballot drop box transfer documents will be investigated thoroughly, as we have with other counties that failed to follow Georgia rules and regulations regarding drop boxes. This cannot continue,” Raffensperger tweeted last Monday.
“Restoring confidence in our elections is going to be impossible as long as Fulton County’s elections leadership continues to fail the voters of Fulton County and the voters of Georgia. They need new leadership to step up and take charge,” he wrote.

Raffensperger was humiliated and essentially caught when, also on Monday, Laura Baigert of The Georgia Star News reported that a Fulton County election official admitted “a few forms are missing” and that “some procedural paperwork may have been misplaced.”
It wasn’t “a few.”
An analysis revealed the number of ballots in question exceeds Biden’s margin of victory of 11,779 votes (0.24 percent) over former President Donald Trump.
President Trump released a statement on Thursday:
“Thank you and congratulations to Laura Baigert of the Georgia Star News on the incredible reporting you have done. Keep going! The scam is all unraveling fast.”

Too late. Amero learned in May from Cheeley that Fulton County Registration Chief Ralph Jones, during a pre-trial deposition, estimated the county printed 20,000 absentee ballots through “a vendor” in the 10 days leading up to the election.
Cheeley also told the judge that Jones could not provide how many absentee ballots were printed or whether any of the ballots were left over.
