In Oregon an Adult Can Expose Themself to a Child and it is Not a Crime

An adult exposing themself to a child in Oregon is not a crime unless there is “intent of arousing” their own sexual desire or the sexual desire of the child.

When we viewed this quick clip, we thought surely the police officer was mistaken when a father reported a naked man came into his yard to expose himself to his daughter. See for yourself:

So, we checked the Oregon State Statutes to verify.

Oreon ORS 163.465
Public indecency

A person commits the crime of public indecency if while in, or in view of, a public place the person performs:

(a) An act of sexual intercourse;

(b) An act of oral or anal sexual intercourse;

(c) Masturbation; or

(d) An act of exposing the genitals of the person with the intent of arousing the sexual desire of the person or another person.

Public indecency is a Class A misdemeanor, but is a “Class C felony if the person has a prior conviction for public indecency or a crime described in ORS 163.355 (Rape in the third degree) to 163.445 (Sexual misconduct) or for a crime in another jurisdiction that, if committed in this state, would constitute public indecency or a crime described in ORS 163.355 (Rape in the third degree) to 163.445 (Sexual misconduct).

  • Over one-quarter of male victims of completed rape experienced their first rape at or before the age of 10.
  • Children with disabilities are 2.9 times more likely than children without disabilities to be sexually abused.
  • Children with intellectual and mental health disabilities appear to be the most at risk, with 4.6 times the risk of sexual abuse as their peers without disabilities.
  • At least 31% of girls and 7% of boys involved in the juvenile justice system have been sexually abused.

    May one ask what else the legislators think the perpetrator is doing? Clearing an infestation of ants? Suffering a collapse of braces or belt? Discovering that trousers bought from China dissolve in the rain?
